These Terms and Conditions apply to the service provided by the website www.thewayexperience.es and The Way Dream in English S.L. (‘The Way’), whose registered office is situated in Camino de los Garres, 33, 30012 Murcia, Spain. Registration details are as follows:

If you use the service provided by The Way, you agree to be bound by the Terms and Conditions detailed as follows. If you do not accept these terms, do not use the service.

This agreement is subject to the following definitions and rules of interpretation:

Agreement refers to the agreement between you and us, including these Terms and Conditions, so we can provide our service to you.

Intellectual Property Rights refer to all patents, database rights, copyright, design rights (registered or unregistered), trademarks (registered or unregistered) and other similar rights anywhere in the world, together with the right to apply for protection of the same.

Liability refers to any and all damages, claims, proceedings, actions, awards, expenses, costs and other losses and/or liabilities arising from the use of the service provided by The Way.

Website refers to our website at URL www.thewayexperience.es

You and your refer to the person or representative of an institution who uses the service.

Subscription refers to a paid-for service allowing you to use The Ways materials and method, in compliance with these Terms and Conditions.

Provision of the service

The Terms and conditions herein specified aim at regulating the use of the services provided by The Way Dream in English S.L. in its website www.thewayexperience.es offering and selling original ESL resources, mainly in English and Spanish, and trips to learn the language in English-speaking countries.

Spanish law governs this agreement and the parties submit to the non-exclusive jurisdiction of the Spanish courts.

Registration

The validity of your registration is subject to the following conditions:

You are responsible for everything related to your account, the use that is made of it, even if another person uses it without your knowledge. If you suspect that someone else may be using your log in information or your account, please let us know as soon as possible at support@thewayexperience.es

Newsletter

The Way will send a newsletter fortnightly to all registered users. This newsletter will contain information and links to new materials uploaded to our site, as well as offers for trips when we publish new ones. You may unsubscribe at any time by clicking the unsubscribe link at the bottom of the email.

The Way reserves the right not to send newsletters in case of force majeure.

Privacy Policy

Your personal information will be used in accordance with our Privacy Policy.

Intellectual Property Rights

This website, its content and The Way’s method are protected by copyright, database rights, trademarks, and other Intellectual Property Rights, and all are owned by The Way. The use that users of our services can make of it is limited to these explicitly stated terms and conditions.

The Way Experience’s Liability

The method, materials, worksheets, templates and any other piece of information in www.thewayexperience.es is for information only, and the result obtained from its use is your responsibility. You should decide for yourself whether and how you would like to use the information available.

Maintenance of the website

The necessary maintenance of this website may make it less accessible at times, as procedures such as diagnosis, installation of updates and the need to fix bugs need to be carried out. Emergency maintenance may also suspend access to the servers temporarily. Should this happen, this website will be available again as soon as it is safe.

Termination

This Agreement will terminate if you or we are in material breach of any of its terms and conditions and if the breach is not remedied after twenty working days after written notice has been given to the party in breach.

On termination of this Agreement, all licenses granted during this Agreement shall immediately terminate. You will delete our content from your electronic media, your intranet, and your electronic storage devices, so you can no longer use any of our electronic material. Your subscription data may be deleted or disposed of.

Subscription Plan for Freemium users.

Freemium subscription plan has been designed so users can enjoy and test The Way’s method, making it easier for them to decide if they want to upgrade so they can enjoy a wider selection of the materials created by The Way.

Once you have registered as a Freemium user, you will have access to The Way’s platform, observing the following terms and conditions:

Subscription Plans for Freelance Teachers.

There are three Subscription Plans for Freelance Teachers, namely Level A, Level B, and Level C, depending on the materials that you have access to.

Once your order has been submitted and the service has commenced, no refund of the fee paid will be given.

Subscription Plans for institutions, language schools, and multiple users.

There are two Subscription Plans, namely Silver, and Gold, depending on the materials that you have access to.

Once your order has been submitted and the service has commenced, no refund of the fee paid will be given.

Payment

Payment for subscription plans is made via credit card, Paypal or bank transfer.

All fees stated in this Agreement are to be paid in Euros, US dollars or Pounds Sterling. Prices include applicable VAT in Spain, where The Way Experience is to pay its taxes.

The prices for subscription are published on the website, in the Pricing section. These prices may change and will be effective from the day they are published on this website.

The goods that you are acquiring are non-tangible and digital, for this reason, no refunds will be given after the purchase has been made.

Warranty

We do not provide any warranty with respect to the service when its unavailability is due to any technical problem on the Internet, servers, providers, computer equipment, etc.

Renewal

Subscription plans are subject to automatic re-billing and will, therefore, automatically renew at the end of the plan’s billing cycle. Users may cancel their subscription any time up to three working days prior to the date the payment is scheduled to take place. You can do so by writing to support@thewayexperience.es. If you purchased your subscription via PayPal, you can cancel the Recurring Payment in your PayPal account.
